Terms of Service
The agreement between you and DigiSignWall covering accounts, acceptable use, billing and cancellation.
Last updated:
Agreement
These terms form a binding agreement between you (or the organisation you represent) and DigiSignWall. By creating an account or using the service you accept them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.
The service
DigiSignWall is cloud digital signage software for managing, scheduling and publishing content to display screens, together with the player software that runs on those screens. We may add, change or remove features; where a change materially reduces functionality you rely on, we will give reasonable notice.
Accounts
You are responsible for the accuracy of your account details, for keeping credentials confidential, and for everything done under your account. Tell us promptly if you suspect unauthorised access. We recommend enabling two-factor authentication.
Acceptable use
You must not use DigiSignWall to publish content that is unlawful, defamatory, infringing, obscene, or that harasses or incites violence. You must not attempt to breach or probe our security, interfere with other customers, resell the service without a white-label agreement, or reverse engineer the software except where the law expressly permits it.
You are solely responsible for content you display, including holding the necessary rights and licences for every image, video, font and font-embedded asset you upload.
Your content
You keep all ownership of the content you upload. You grant us a limited licence to host, transcode, cache and transmit it purely so we can deliver it to your screens. We do not use your content to train models, and we do not display it outside your account.
Plans, billing and trials
Paid plans bill in advance on a recurring basis until cancelled. Fees exclude taxes, which are added where applicable. Free plans are provided as-is and may change or end with notice.
We may change pricing with at least 30 days’ notice before your next renewal. Continuing to use the service after that constitutes acceptance. Except where the law requires otherwise, payments are non-refundable, though we will consider pro-rata refunds for extended outages caused by us.
Availability
We aim for high availability and publish an uptime commitment on Enterprise plans. Availability excludes scheduled maintenance we have announced in advance, and outages caused by your equipment, network or third-party services. Players cache content and continue playing during a network interruption.
Cancellation and suspension
You may cancel at any time; the service continues to the end of the paid period. We may suspend or terminate an account that breaches these terms, poses a security risk or has unpaid fees, and will give notice and a chance to fix the problem where it is reasonable to do so.
On cancellation you can export your content for 30 days, after which we delete it.
Warranties and liability
The service is provided without warranties beyond those the law implies and cannot be excluded. To the extent permitted by law, neither party is liable for indirect or consequential loss, or for lost profits, revenue or data. Our total liability in any 12-month period is limited to the fees you paid us in that period. Nothing here limits liability for death or personal injury caused by negligence, or for fraud.
Changes and governing law
We may update these terms and will post the revised version here with a new date. Material changes will be emailed to account holders in advance. Disputes are governed by the laws of the jurisdiction in which DigiSignWall is established, and the courts there have exclusive jurisdiction.
